Extrajudicial procedure for declaring a citizen bankrupt
Federal Law No. 289-FZ of July 31, 2020 "On Amendments to the Federal Law "On Insolvency (Bankruptcy)" and Certain Legislative Acts of the Russian Federation regarding the out-of-court bankruptcy of a citizen, it is established that from 01.09.2020 a new out-of-court procedure for declaring a citizen bankrupt is introduced.
Currently, a citizen who meets the criteria for an out-of-court procedure can file an application for recognition of himself as bankrupt, out-of-court, at his place of residence or place of stay in a multifunctional center for the provision of state and municipal services (MFC).
Examination of an application for declaring a citizen bankrupt out of court in a multifunctional center for the provision of state and municipal services is carried out free of charge.
The grounds, procedure for filing and consideration of an application for declaring a citizen bankrupt out of court are regulated by Paragraph 5 of Chapter X of the Federal Law "On Insolvency (Bankruptcy)".
In accordance with paragraph 1 of Article 223. 2. of the Federal Law "On Insolvency (Bankruptcy)" a citizen whose total monetary obligations and obligations to make mandatory payments (excluding those provided for in paragraph four of paragraph 2 of Article 4 of this Federal Law), including obligations whose due date has not yet come, obligations to pay alimony and obligations under a suretyship agreement, regardless of the delay of the main debtor, is not less than fifty thousand rubles and not more than five hundred thousand rubles, has the right to file an application for declaring him bankrupt in an extrajudicial order, if on the date of filing such an application, enforcement proceedings have been completed in relation to him in connection with the return of the writ of execution to the recoverer on the basis of paragraph 4 of part 1 of Article 46 of the Federal Law of 02. 10. 2007 No. 229-FZ "On enforcement proceedings" (regardless of volume and composition of the requirements of the recoverer) and no other executive final proceedings after the return of the writ of execution to the recoverer.
