Bankruptcy of individuals
Since October 1, 2015, the Russian Federation has introduced the possibility of bankruptcy of individuals, which is admissible as a general rule if the requirements for a citizen are at least 500 thousand . rub. and these requirements are not fulfilled within three months from the date when they must be fulfilled (Part 2 of Article 213. 3 of the Federal Law "On Insolvency (Bankruptcy)"). The citizen, the bankruptcy creditor and the authorized body have the right to apply to the arbitration court with an application for declaring a citizen bankrupt.
An application for declaring a citizen insolvent (bankrupt) is submitted to the arbitration court at the place of registration of the debtor.
The right to apply to an arbitration court with an application for declaring a citizen who is an individual entrepreneur bankrupt arises for such a citizen, subject to the preliminary (at least fifteen calendar days before the day of applying to the arbitration court) publication by him of a notice of intention to file an application on declaring him bankrupt by including this notification in the Unified Federal Register of Information on the Facts of the Activities of Legal Entities.
The list of documents to be submitted to the court by a citizen is regulated by Article 213. 4 of the Federal Law "On Insolvency (Bankruptcy)".
The application for declaring a citizen bankrupt shall indicate the name and address of the self-regulatory organization, from among whose members the financial manager must be approved.
Funds for the payment of remuneration to the financial manager in the amount equal to the fixed amount of the remuneration of the financial manager for one procedure applied in the bankruptcy case of a citizen (25,000 rubles) are deposited with the arbitration court.
At the request of a citizen, the arbitration court has the right to grant the citizen a deferral of depositing funds for the payment of remuneration to the financial manager until the date of the court session to consider the validity of the application for declaring the citizen bankrupt.
In accordance with Article 333.21 of the Tax Code of the Russian Federation, when filing an application for declaring a debtor insolvent (bankrupt), a state fee of 300 rubles is payable.
