Territorial jurisdiction

The Supreme Court of the Chechen Republic is part of the system of federal courts of the Russian Federation and considers cases within its competence as court of first and second instance, in the manner of supervision and due to newly discovered circumstances. He is a higher authority in relation to district courts operating in the territory of the Chechen Republic.

Civil cases are considered by the Supreme Court of the Chechen Republic as a court of first instance, on appeal, in a supervisory review and due to newly discovered circumstances.

In accordance with Art. 337 Code of Civil Procedure of the Russian Federation, on appeal (2 instances), the Supreme Court of the Chechen Republic considers complaints of decisions of district courts and garrison military courts that have not entered into legal force.

In a cassation appeal, the Judicial Collegium for Criminal Cases of the Supreme Court of the Chechen Republic filed complaints against the verdict or other decision of the first or appeal instance of the district court.

The verdict and resolution of a justice of the peace, the verdict, ruling and resolution of a district court, the cassation ruling of the Supreme Court of the Chechen Republic can be appealed to the Presidium of the Supreme Court of the Chechen Republic.

Also, the Presidium of the Supreme Court is considering the opinion of the prosecutor on the need to resume proceedings in the criminal case due to new or newly discovered circumstances regarding the sentence, ruling, decision of the district court.
