SMS notifications

Order of the Judicial Department under the Supreme Court of the Russian Federation No. 131 of July 05, 2012 approved the Temporary Regulations for the organization of notification of participants in legal proceedings by means of SMS messages. The Provisional Regulations have been developed in accordance with the procedural legislation of the Russian Federation, in compliance with the requirements of the Instruction on Judicial Proceedings in the District Court, approved by order of the Judicial Department at the Supreme Court of the Russian Federation dated April 29, 2003 No. 36, the Guidelines for Procedural Proceedings in Military Courts Resolutions of the Plenum of the Supreme Court of the Russian Federation of December 20, 2011 No. 21 "On the Practice of the Application of Legislation on Execution of Sentences by Courts of General Jurisdiction" and No. 3 of February 9, 2012 "On Amendments to Certain Resolutions of the Plenum of the Supreme Court of the Russian Federation". The Regulation provides an opportunity for courts of general jurisdiction to use SMS messages to notify participants in court proceedings about the place, date and time of court hearings. Notification of the participants in the process can be carried out subject to their consent to receive notifications in this way and the fact of sending and delivering an SMS message to the addressee is recorded.
In civil proceedings, the plaintiff, when filing a statement of claim in court, and the defendant and other persons, at the first appearance in court, will be offered this method of notification. The fact of consent to receive an SMS notification is confirmed by a receipt, in which, along with the information about the participant in the proceedings and his consent to the notification in a similar way, the mobile phone number to which it is sent is indicated.
Receiving a notice of the court session by means of an SMS message, the participant in the trial gets rid of the appearance at the post office to receive a summons. If it is necessary to send a notice with the attachment of documents, the judicial correspondence will be sent to the addressees, as it was before - by registered mail. If the SMS notification was not delivered to the subscriber after two attempts to re-send, the notification or summons to the court of the participant in the trial is carried out by a subpoena with acknowledgment of receipt or by another method established by the current legislation.
This method of notification can also be used in criminal proceedings, since the Criminal Procedure Code of the Russian Federation does not contain any prohibitions for notifying interested parties using SMS messages.
