SMS notification of participants in civil, criminal and administrative proceedings

The Sokolsky District Court of the Nizhny Novgorod Region has implemented the possibility of notifying the participants in the proceedings about the place, date and time of the consideration of the case in court using SMS messages. The fact of consent to receive an SMS notification is confirmed by a receipt, in which, along with the data on the participant in the proceedings and his consent to notification in this way, the mobile phone number to which the SMS notification is sent is indicated.

By the Order of the Director General of the Judicial Department at the Supreme Court of the Russian Federation dated December 25, 2013 No. 257, the Rules for organizing the notification of legal proceedings by means of SMS messages were approved.

The Regulations establish the general procedure and rules for notifying the participants in the proceedings about the date, time and place of the consideration of the case or the performance of certain procedural actions by sending them SMS messages through a specialized Internet resource.

The participants in the trial can use the right to receive notification of the upcoming trial by SMS.

Notification of the participants in the proceedings by means of SMS messages is carried out only with the consent of the participants in the proceedings, which is confirmed by a receipt indicating the mobile phone number. A participant in the proceedings has the right, at his discretion, to indicate any phone number of any mobile operator operating in the territory of the Russian Federation, and will be considered notified from the moment an SMS message is received at the mobile phone number indicated by him.

The receipt is selected at any stage of the proceedings: when filing an application with the court, when you first appear at the court session, when preparing the case for the court session, etc.

Receipt of consent to receive SMS notifications, as well as a report on the delivery of the sent SMS notification to the addressee, are attached to the case file.
