Notifying the participants in the trial of the date, time and place of the court session via sms
In accordance with paragraph 2. 1 of the Temporary Model Regulations for Notifying Participants in the Proceedings via SMS, Order of the Judicial Department at the Supreme Court of the Russian Federation of July 5, 2012 No. 131, participants in legal proceedings can be notified by SMS messages about the place, date and time of the court session or the performance of certain procedural actions within the framework of civil, criminal and administrative proceedings.
2. 2. Notification of participants in legal proceedings via SMS messages is allowed only if the following two conditions are met:
the consent of the participant in legal proceedings to notify him via SMS messages;
fixing the fact of sending and delivering an SMS notification to a participant in legal proceedings.
2. 3. SMS notifications are sent to the participants in the proceedings so that these persons have sufficient time to prepare for the case and appear in court in a timely manner.
2. 4. SMS notification is carried out only with the consent of the participant in the proceedings, that is, on a voluntary basis.
The fact of consent to receive an SMS notification is confirmed by a receipt (Appendix 1), in which, along with the data on the participant in the proceedings and his consent to notification in this way, the mobile phone number to which it is sent is indicated.
Receipt of consent to notification via SMS with a mobile phone number is selected when submitting an appropriate application to the court, at the first appearance at a court session, when preparing a case for a court session, etc.
A receipt confirming the fact of consent of a participant in legal proceedings to be notified of the place, date and time of the court session via SMS messages, is attached by the court and filed in the court file by the appropriate employee of the court apparatus.
2. 5. The court without fail ensures the recording of the facts of sending and delivery to the addressee of an SMS message with notification of the place, date and time of the court session.
The fact of sending and delivery of an SMS notification is confirmed by the details of the SMS notification (information on the date and time of sending the SMS message, the text of the sent SMS message, the date and time of delivery of the SMS message to the participant in the proceedings), which is printed on paper and attached to the case file.
